Terms of sale

These terms apply to every purchase of a GeneratePerf license on generateperf.com. By placing an order, you accept them without reservation.

1. Seller

2. Product

GeneratePerf is a proprietary WordPress plugin for the GeneratePress theme. A license gives you, for the duration of your subscription:

• The right to use GeneratePerf on the number of production sites of your plan (1, 5 or 50, or as agreed in a custom offer);
• Access to new versions through the WordPress Updates screen and to downloads from your account;
• Support by e-mail.

Staging, development and local sites that use your license key do not count toward your number of sites.

3. Prices

Prices are shown in euros, excluding VAT. VAT is calculated at checkout according to your country; businesses established in another EU member state that provide a valid VAT number are invoiced without VAT (reverse charge). We may change our prices; a new price applies only from your next renewal, and we inform you by e-mail at least 30 days before.

4. Order and payment

Orders are placed and paid online by card through Stripe’s secure checkout. Once payment is confirmed, you receive your license key and a link to your customer account by e-mail. Invoices are available in your account.

5. Duration, renewal and cancellation

Your subscription lasts one year from the payment date and renews automatically for one year at the price then in force. You can cancel at any time from your account: cancellation takes effect at the end of the current period, and the period already paid is not refunded, except where the law provides otherwise.

If a renewal payment fails, you keep access for a short grace period while payment is retried; after that, updates and support stop until payment is made.

6. Right of withdrawal

If you are a consumer, you have 14 days from your purchase to withdraw, without giving a reason, by contacting us. However, you lose this right once you have downloaded or activated GeneratePerf, if you expressly asked for immediate access to the plugin and acknowledged that you would lose your right of withdrawal (article L221-28 13° of the French Consumer Code). Business customers do not benefit from a right of withdrawal.

7. License terms

The license is personal and non-transferable. You may not resell, rent, sublicense or redistribute GeneratePerf, publish its code or remove its license checks. Your license key must not be shared outside your organisation or your clients’ sites covered by your plan. We may suspend a license used in breach of these terms.

8. When your license ends

GeneratePerf keeps working on your sites with all your settings, but they no longer receive new versions, and support is no longer provided, until you renew.

9. Support

Support is provided by e-mail, from the Support tab of your account or through our contact form, on business days; we usually answer within 24 to 48 hours. Support covers the use of GeneratePerf; it does not include custom development or the optimisation of your site, which are services offered separately by Agence Web Performance.

10. Liability

GeneratePerf is regularly tested with GeneratePress and the most common plugins, but we cannot guarantee compatibility with every theme, plugin or hosting configuration. Back up your site before installing or updating a plugin. For business customers, our total liability is limited to the amounts paid for the license during the twelve months preceding the event giving rise to the claim.

11. Personal data

Your personal data is processed as described in our privacy policy.

12. Governing law and disputes

These terms are governed by French law. In the event of a dispute, we will first look for an amicable solution with you. If you are a consumer, you may also refer the matter free of charge to a consumer mediator. Failing an amicable solution, the French courts have jurisdiction.
